Terms of Use

These Terms of Use (“Terms”) govern your use of the GardenerNick app (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service.

2. Subscriptions & billing

• The free tier includes up to three plants, one user-started health check per day, and five user messages to Nick per day. The first assessment created while adding a plant does not use the daily health-check allowance.
• GardenerNick offers an optional auto-renewable subscription (“Pro”) that removes those limits, providing unlimited plants, health checks, and conversations with Nick while the subscription is active.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, from GardenerNick's Settings → Subscription → Manage Subscription or your App Store account settings after purchase.
• Prices are shown in the App before purchase and may vary by region. Any free trial duration, and what it converts to, is disclosed at the point of purchase; unused trial time (if any) is forfeited when you buy a subscription.

3. AI-generated content — important

Plant identification, health assessments, and care advice are generated by artificial intelligence and are provided for informational purposes only. They may be incomplete or inaccurate. GardenerNick is not a substitute for professional horticultural, agricultural, or veterinary advice.

• Always use your own judgment, and verify independently before acting on advice — especially regarding plants that may be toxic to people or pets, the use of fertilizers or pesticides, or any plant you intend to consume.
• We make no warranty that an identification or assessment is correct.

4. Acceptable use

You agree not to misuse the App, including by attempting to disrupt the service, reverse engineer it except as permitted by law, submit unlawful content, or use it to violate the rights of others.

5. Your content

You retain ownership of the photos and notes you create in the App. You grant us only the limited rights needed to operate the features you use — for example, transmitting a photo to AI providers to return an identification or assessment, as described in our Privacy Policy.

6. Intellectual property

The App, including its name, design, illustrations, and the “Nick” persona, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding.

7. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that AI results will be accurate.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of or damage to plants, arising out of or relating to your use of the App.

9. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate access if you materially breach these Terms.

10. Changes

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
